Is renters insurance legally required for tenants in Florida?

Florida state law does not require tenants to carry renters insurance. There is no statute mandating it the way Florida requires auto insurance. However, that one-sentence answer misses what actually matters for most renters in Jacksonville and Northeast Florida — because while the law doesn't require it, your lease almost certainly does.

When It Becomes Required

Florida landlords are legally permitted to require renters insurance as a condition of the lease. Most professional property managers and larger landlords include this requirement as standard — often specifying a minimum liability coverage amount and requiring proof of a current policy at move-in and at each renewal.

When you sign a lease with a renters insurance clause and then let your policy lapse, you're in breach of contract. That gives the landlord grounds to take action, including initiating eviction procedures. It's not a technicality — it's an enforceable lease term.

Some HOA-governed communities and condo associations in Northeast Florida add another layer, requiring proof of coverage independently of whatever the landlord requires. If your rental is inside a community like that, you may be subject to both.

What Renters Insurance Actually Covers

A standard renters insurance policy — called an HO-4 — covers three things your landlord's policy doesn't:

  • Your personal belongings — furniture, electronics, clothing, and other possessions if damaged by a covered event like fire, theft, or certain weather events

  • Liability — if someone is injured in your rental and you're found responsible

  • Temporary living expenses — hotel or alternate housing costs if your unit becomes uninhabitable after a covered loss

It does not cover flooding. In Florida, that requires a separate flood policy — worth knowing given the state's storm and water exposure.
